Who you're agreeing with

habb is a brand operated by Valiso Ventures LLC, a Delaware limited liability company ("habb," "we," "us," "our"). Mailing address: 800 N King Street, Suite 304-3217, Wilmington, DE 19801. Reach us at hello@habb.co.

By using habb.co or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the site.

Eligibility

You must be at least 18 years old to place an order. If you're between 13 and 17, you can browse, but a parent or guardian must place the order. We do not knowingly accept orders from children under 13 — see our Privacy Policy for the full COPPA/CCPA child-rights section.

Your account

If you create an account or subscribe, you agree to (a) provide accurate information, (b) keep your login credentials secure, and (c) notify us at hello@habb.co if you suspect unauthorized use. You are responsible for activity under your account until you tell us otherwise.

Pricing and payment

• Subscribe (Phase 1 packets): $24 your first month of subscription (30 packets, 52% off the $50/mo standard sub price, includes Welcome Kit, free shipping; snaps to $50/mo from month 2). $50 per 30-day box recurring thereafter on the cadence you choose at checkout. Annual prepay $528 ($44/mo, 20% off monthly). Skip or cancel anytime. First 250 annual subscribers lock $44/mo for life as long as they remain continuously subscribed (Founding Member 250).
• One-time purchase (Phase 1 packets): $55 for the 30-day box (30 packets, no Welcome Kit, $4.99 flat-rate shipping).
• Phase 2 bottle (spring 2027): $55 per 4oz bottle one-time / $48 subscribe.
• Prices are in U.S. Dollars and exclude applicable sales tax (calculated at checkout based on your shipping address) and shipping (see Shipping).
• Payment is processed by Shopify Payments (which uses Stripe as its underlying processor). We do not store full card numbers — only a tokenized reference so we can process refunds if needed.
• If your payment is declined, your order won't ship. We'll email you so you can update your method.

We may change prices at any time. Price changes do not apply retroactively to orders already placed; for active subscriptions, we will email you at least 30 days before any price change takes effect on your renewal.

Pre-orders and ship-date disclosure (FTC compliance)

This section satisfies the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 CFR §435), which governs any product offered for purchase before it has shipped. Phase 1 packets pre-orders during the validation phase (June–October 2026) and Phase 2 bottle pre-orders (Q4 2026 onward) both fall under this rule. Read this if you are placing a pre-order.

1. Estimated ship date is disclosed at checkout. Every pre-order page states an estimated ship date prominently above the buy button (e.g., "Ships approximately November 2026"). The ship date is also repeated in the order confirmation email and in the Customer Portal at habb.co/account.
2. If we cannot ship by the estimated date, we will email you with a revised date and ask for your consent. If you do not consent within 30 days, we will refund your order automatically without deducting any fees.
3. You can cancel a pre-order any time before it ships. Email hello@habb.co with your order number, or use the Customer Portal at habb.co/account. Full refund to your original payment method within 5–7 business days. No restocking fee, no cancellation fee.
4. Refund capacity is reserved. habb maintains 100% refund capacity for all open pre-orders at all times. We do not use pre-order capital to fund manufacturing without retaining the reserves needed to refund every open order. This is required by the FTC rule and we honor it operationally.
5. Pre-order updates by email. You will receive at minimum: order confirmation (immediate), production update (~2 weeks before ship), shipping notification (when carrier picks up), and delivery confirmation. The 30-day "ships within X days" clock starts at order placement; we communicate any delay in writing within that window.
6. Pre-order pricing is locked at order placement. If habb's standard pricing changes between your pre-order date and the ship date, you pay the price you saw at checkout — not the new price. Founding Member 250 pricing is locked at order placement and continues for the life of the continuous subscription.

If you are uncertain whether you placed a pre-order or a regular order, check your order confirmation email — pre-orders are explicitly marked "PRE-ORDER" in the subject line and the "Ships [date]" notice is in the email body.

Subscription terms (auto-renewal disclosure)

This section satisfies the California Automatic Renewal Law (Bus. & Prof. Code §17600 et seq.) and the Federal Trade Commission's Negative Option Rule (effective January 2025). Read it before you subscribe.

1. What auto-renews: If you choose Subscribe & save, your card on file is charged on the cadence you selected (e.g., every 30 days, every 60 days). We send each shipment automatically until you cancel.
2. What you pay: $50 per 30-day packet box per shipment (Phase 1 packets) or $48 per 4oz bottle per shipment (Phase 2 bottle, spring 2027), plus applicable sales tax and any shipping not covered by free-shipping thresholds. The frequency you chose controls how often this charge happens.
3. How long it continues: Indefinitely, until you cancel.
4. How to cancel — three ways, all free:
   • Customer Portal: log in at habb.co/account, click Manage subscription, then Cancel. One-click. No hold steps. No "are you sure" loops beyond a single confirmation.
   • Email: send a cancellation request to hello@habb.co. We confirm within one business day.
   • Phone: call our toll-free number (printed on every bottle and at the bottom of every email). We cancel on the call.
5. Cancellation effective date: Cancellation stops the next charge. If you cancel within 24 hours of an upcoming charge, that charge may already have processed; in that case the next shipment ships and we cancel after that.
6. Pause instead of cancel: the same Customer Portal lets you pause for 30, 60, or 90 days, or skip a single shipment.
7. Reminder before renewal: for charges $99 or more (e.g., annual prepay subscription), we email you between 3 and 21 days before the charge, per Cal. Bus. & Prof. Code §17602(b).
8. Refunds for unwanted renewals: if your card is charged for a renewal you didn't want, email hello@habb.co within 30 days and we will refund the charge. The habb Guarantee (see /guarantee) covers product satisfaction separately — 90 days from delivery for subscribers, 30 days for one-time orders.

Order processing, shipping, and returns

Refunds and the habb Guarantee for product satisfaction (90 days from delivery for subscribers, 30 days for one-time orders) are covered at /guarantee. Both are part of these Terms.

Health disclaimer (DSHEA)

habb is a dietary supplement. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

habb is not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting a new supplement, particularly if you are pregnant, nursing, taking prescription medication, or managing a medical condition. If you experience an adverse event, stop use immediately and contact our adverse-event line at adverse-events@habb.co or the toll-free number printed on every bottle.

Reviews, content, and other things you submit

If you post a review, photo, video, or other content on habb.co, social media tagging us, or in response to a habb email — together, "User Content" — you grant habb a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to use, reproduce, modify, and display your User Content for marketing, customer service, and editorial purposes, with attribution where reasonable. You can revoke this license for future use by emailing hello@habb.co; previously published uses won't be retracted.

You promise that your User Content (a) is yours to share, (b) does not violate anyone else's rights, (c) does not contain medical claims about your specific health condition that we have not asked you to make, and (d) does not violate FTC endorsement rules — if we paid you, sent you free product, or compensated you in any way, you must disclose that material connection in the content itself (the U.S. Federal Trade Commission requires it; we require it too).

Intellectual property

"habb," the habb wordmark, the habb monogram, the bottle design, and the ceramic-spoon serving artifact are trademarks (registered or pending) of Valiso Ventures LLC. The words on this site, the photographs, the layouts, the source code, and the lab-card design are protected by copyright, owned or licensed by Valiso Ventures LLC.

You may quote habb.co for normal personal, editorial, or journalistic use with attribution and a link back. You may not (a) reproduce more than one short paragraph or one image without our written permission, (b) use any habb mark in a way that suggests endorsement or affiliation we haven't granted, or (c) use any habb intellectual property to train a generative model without our written permission. The "right of publicity" of habb founders and team members is reserved.

Copyright complaints (DMCA): if you believe content on habb.co infringes your copyright, send a written notice to hello@habb.co with the elements required under 17 U.S.C. §512(c)(3). We will review and respond within 14 days.

Things you can't do on habb.co

• Scrape, crawl, or systematically download habb.co except as permitted by our robots.txt.
• Use the site to send spam, phishing attempts, malware, or anything illegal.
• Reverse-engineer or interfere with our systems, including the consent banner, the Shopify checkout, or the lab-card lookup endpoint.
• Impersonate habb or a habb employee.
• Buy product for resale on Amazon or any other marketplace without our written permission. Unauthorized resellers will be reported to Amazon Brand Registry and removed.

Disclaimer of warranties

habb.co and the products are provided "as is." Beyond the habb Guarantee at /guarantee and any warranties that cannot be disclaimed under applicable law, we make no warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the site will be available without interruption.

Limitation of liability

To the fullest extent permitted by law, Valiso Ventures LLC, habb, and our officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the product. Our aggregate liability for any direct damages is limited to the greater of (a) the amount you paid for the order at issue or (b) $100. Some jurisdictions don't allow these limits; in those, our liability is limited to the maximum the law allows.

Nothing in this section limits our liability for injury caused by our gross negligence or willful misconduct, or for any liability that cannot be limited under applicable law.

Indemnification

If your User Content, your misuse of the site, or your violation of these Terms causes a third party to sue us, you agree to defend, indemnify, and hold habb harmless for the resulting losses, costs, and reasonable attorneys' fees. We will tell you promptly if a claim arises and you may take over the defense at your expense.

Governing law and disputes

These Terms are governed by the law of the State of Delaware, without regard to conflict-of-law rules.

Try email first. If something goes wrong, email hello@habb.co with the details. We aim to resolve nearly everything by email within 30 days. Most disputes don't need a court.

Arbitration of remaining disputes. Any dispute that we can't resolve by email will be settled by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules (or, if you and we agree in writing, the American Arbitration Association under its Consumer Arbitration Rules). The arbitration will be held in Delaware or, at your election, in your home state. Each side bears its own costs except that habb will pay the arbitrator's fees that exceed what you would have paid in small-claims court for the same dispute.

Class-action waiver. Disputes will be arbitrated only on an individual basis. You and habb waive the right to participate in a class action, class arbitration, or representative proceeding. If a court determines this waiver is unenforceable, the entire arbitration clause is severable and the dispute will be heard in court — not as a class.

Small claims carve-out. Either of us may bring an individual claim in small-claims court instead of arbitration, as long as the claim qualifies and stays in that court.

30-day opt-out of arbitration. You may opt out of the arbitration clause within 30 days of your first order by emailing hello@habb.co with subject line Arbitration opt-out and your full name + the email on file. Opting out doesn't affect any other part of these Terms.

If a part of these Terms is unenforceable

If any provision of these Terms is found unenforceable, the rest stays in effect. The unenforceable provision will be limited or rewritten to the minimum extent needed to make it enforceable, in keeping with the original intent.

Force majeure

habb is not liable for delays or failures caused by events beyond our reasonable control — including acts of God, natural disasters, pandemics, war, terrorism, civil disturbance, labor disputes, embargoes, supplier failures, carrier failures, or government action. We will resume performance as soon as the cause is removed.

Changes to these Terms

We may update these Terms over time. The "Last updated" date at the top tells you when. Material changes will be flagged in the next email we send you and on the site for at least 30 days. Continued use after the effective date counts as agreement to the updated Terms; if you don't agree, stop using the site and cancel any active subscription.

Entire agreement

These Terms, together with our Privacy Policy, Cookies Notice, Shipping page, and the habb Guarantee, are the full agreement between you and habb. They supersede prior verbal or written representations on the same topics.
